Terms of service
Patchferry is operated by Sheikh Rahat Mahmud, Shewrapara, Mirpur, Dhaka, Bangladesh. Contact: patchferry.help [at] gmail.com, WhatsApp +880 1518-732192.
1. What we do
Patchferry provides PHP security patching, PHP version upgrades, related code changes, and ongoing maintenance ("the services"). The exact scope, price and timeline of each job are set out in a written quote. When you accept a quote, these terms apply to that job.
2. Your responsibilities
- You confirm that you own the systems and code you ask us to work on, or that you're authorized to give us access to them.
- You keep current backups of your systems and data before we start. We take precautions, but you're responsible for your own backups.
- You give us the access we agree on (for example a temporary SSH user, a git repository or a staging copy), and you remove that access when the job ends.
- Where we deliver changes as a pull request or staging build, you review and approve them before they go live.
3. How we work
- We only access systems you've authorized, and only for the agreed job.
- We test upgrades on a copy or a separate branch before go-live where the setup allows it.
- We keep your code, data and credentials confidential, and we delete copies of your code within 30 days of finishing the job, unless you ask us to keep them for an ongoing plan. We sign your NDA on request.
- We don't scan, test or access any system we haven't been asked to work on.
4. Prices and payment
- Prices are in US dollars and shown on our website or in your quote.
- Jobs under $500 are paid in full before work starts. Larger jobs are paid 50% before work starts and 50% on delivery.
- Monthly plans are billed monthly in advance and can be cancelled any time, effective at the end of the paid month.
- You pay any bank or transfer fees on your side, so we receive the invoiced amount.
5. Guarantee and refunds
If we can't deliver the agreed scope of a fixed-price job, you get a refund for that job, as described in our refund policy.
6. Warranty
For 14 days after delivery, we fix any problem caused by our changes within the agreed scope, at no charge. Security work reduces risk but can't guarantee that a system will never be compromised, especially by flaws that weren't known when we did the work or that sit outside the agreed scope.
7. Limitation of liability
To the extent the law allows, our total liability for any job is limited to the amount you paid for that job, or for monthly plans, the fees paid in the 3 months before the claim. We're not liable for indirect losses such as lost profits, lost data where you didn't keep backups, or business interruption.
8. Ownership
Once you've paid, you own the code changes we make for you. Our own tools and scripts, including our check scripts, remain ours, and you can use them freely on your own systems.
9. Ending a job
Either side can end a job with written notice. You pay for the work done up to that point, and we hand over everything completed.
10. Law
These terms are governed by the laws of Bangladesh. We'll always try to solve disagreements by talking first.
